Time limits

Is there a time limit on making a claim?

Yes. If you think that you have been the victim of discrimination or another form of unfair treatment then you will typically need to make an employment tribunal claim within three months of the event happening.

This means that if you are unfairly dismissed or made redundant, you will need to make the claim within 3 months of being dismissed from your job. If your employer fails to pay you, breaches your contract or discriminates against you for any reason, you will have to make your claim within three months of the incident.

It is important that you adhere to this time limit as there are only extremely limited circumstances in which an employment tribunal will allow you to make a claim outside of the three month window. This means it is worth seeking legal advice as soon as you suspect you may have a valid employment tribunal claim so that the process can be put into motion as soon as possible.
